California DUID Laws & Penalties

A DUID is considered a misdemeanor offense, punishable by a maximum six-month jail sentence, fines of up to $1,000, and license suspension for up to six months. These are the same penalties for a DUI conviction.

However, if a DUID offense is the suspect’s fourth or subsequent offense, the crime involved injury to another person, or the suspect has one prior felony DUI conviction, then the DUID will be charged as a felony. A felony DUID carries a jail term of up to three years--or four years in the event of an injury--and fines of up to $1,000--or $5,000 in the event of an injury.
